GA Court Decision

This case involves a couple of left their two dogs at a boarding kennel, one of which needed medication. However, the kennel gave the wrong dog the medication and that dog ultimately passed away from kidney failure.  The kennel's argument on not paying for the treatment (which came to be $67,000) was the dog was a rescue thus had no "fair market value". 

While it stopped short of allowing for emotional loss, it shot down the notion that simply because she was a rescue and/or not a show dog who earned money, she had no "value".  I am glad the Court shot that down in an unanimous decision.  But sad that it took going all the way to the Georgia Supreme Court for a decision on which basic human decency should have prevailed.

Thank you for posting this. It certainly gives one something to ponder.  Since I have a rescue, I certainly take exception to the kennel's argument - what a stand to take when you run a dog business.  I understand trying to get out of fiscal responsibility, but no one in their right mind would leave their dog with you.

It's all about "replacement value". Sadly, companion animals are still considered property under the law.

When we had our car accident and Gordie was injured, we had to claim it as property damage - still fighting that bill, but to devalue exactly what your business is, is a bit ironic.

I can't imagine anyone wanting to leave their dog with these people, rescue or not. They obviously don't value every dog.

This is just outrageous! I know many of us would say that a rescue dog has more value than one they purchased. Currently, I have both and could not place enough value on either one of them. It is heartbreaking that they are seen as a property that can be easily replaced.
