A former eastern Pennsylvania kennel owner is seeking release from jail midway through his sentence on animal cruelty charges.

Forty-two-year-old Derbe Eckhart began serving a sentence of six to 23 months on May 18. His attorney, Jeffrey Conrad, said Monday the term was too harsh and probation would have been more appropriate.

If the sentence stands, Conrad is asking Lehigh County Judge Robert Steinberg to set bail so that Eckhart can be freed pending a ruling on an appeal of the conviction. He said his client is not a flight risk because he has family and loved ones in the area. Senior Deputy District Attorney Heather Gallagher is opposing the motions.

A jury convicted Eckhart in March of animal cruelty and violating an order barring him from taking new dogs into his Almost Heaven kennel in Upper Milford Township. Last month, he was sentenced to probation after pleading guilty to assaulting a guard four days after entering jail.

GREAT USE FOR BASEBALL BATS...
We have two female Maltese in our rescue program which were found in an overcrowded garage in Las Vegas. The low-life, semi-human piece of trash had these two girls, who were pregnant, in a small Varikennel without food or water. The garage was over 120 degrees. Animal control was called and they turned the two girls over to American Maltese Rescue.
Each of these girls had their puppies within a couple of days after they arrived at our home. They were skin and bones but, gave birth to healthy litters of 4-puppies each. One of the girls had a puppy that was lodged sideways and needed a C-section to deliver. Without the intervention, she and her litter would have died.
I don't know what happened to the low-life scum who had this garage full of unfortunate animals but, I wish I could have introduced him to Mr. Louisville Slugger. (For the baseball challenged, the Louisville Slugger company is a famous manuacturer of baseball bats!)
Anyway, these darling girls are doing just fine and despite their terrible life are just loving and friendly to everyone. There is one residual from the conditioning of living in the garage without sufficient food. We have to feed these girls separately because they will steal food from any other dog. Hopefully, they will learn that there is always plenty of good food at our house.

I am outraged about the whole thing also. And how could letting him out even be considered when he assaulted a guard???? How do you get probation for that????

What are his real chances for getting out? (Any lawyers here?)
I would be an outrage if the judge lets him out.

The jerk probably didn't like being in a cell, yet he thinks it is ok for a dog day in and day out. Too bad it wasn't one on top of the other (his being on the bottom) and everyone doing their business on top of his head. What I can't believe is that he only got 6 to 23 months. What a shame if he gets out pending appeal and why if he assaulted a guard, weren't new charges brought against him?
